• Account — the user profile registered on our platform.
• Authorised Use — any use that complies with these Terms, our Responsible Use Policy, and applicable laws.
• Prohibited Use — activities expressly forbidden under these Terms.

You may use our services only if you are at least 18 years old, have full legal capacity, agree to comply with these Terms, and are not prohibited from using proxy services under applicable law.

To access the Service, you must create an Account. You agree to provide accurate and complete information, maintain the confidentiality of your credentials, and accept responsibility for all activity under your Account.

Notify us immediately at support@dataheaven.ai of any unauthorised access. We reserve the right to reject or suspend accounts to ensure security and compliance.

Permitted uses include: public data collection, market research, SEO monitoring, ad verification, brand protection, price comparison, travel fare aggregation, and compliant cybersecurity testing.

Prohibited uses include: unauthorised access to systems or accounts; scraping of private or gated data; bypassing security measures or CAPTCHAs; creating or managing fake accounts; hacking or vulnerability probing; spam, DDoS, or malware distribution; fraud or deception; privacy violations; and any activity that violates applicable law or third-party Terms of Service.

We strive for high availability; however, the Service may be interrupted for maintenance, upgrades, or unforeseen events. We are not liable for downtime or service disruptions, and no specific service level is guaranteed unless specified in a separate written agreement. We may modify or discontinue features at any time with reasonable notice.

Pricing: Prices are listed on our website and may be updated at our discretion. Current pricing is $1.00 per GB of bandwidth.

Billing: By purchasing a plan or topping up, you authorise us to charge your payment method for the applicable amount.

Refunds: Refund requests may be considered if submitted within 24 hours of an initial purchase where the plan was not substantially used and no Terms violation occurred. We reserve the right to refuse refunds for misuse or excessive resource consumption.

All content, trademarks, software, documentation, and materials on our website or provided as part of the Service are the exclusive property of DataHeaven.ai or its licensors. You may not copy, modify, distribute, reverse engineer, resell, or sublicense any part of our platform without prior written permission.

You are solely responsible for all data transmitted through our infrastructure, ensuring you have the legal right to access and process any data, maintaining the security of your account credentials, and ensuring all activity is lawful and ethical. DataHeaven.ai is not responsible for user activities conducted through the Service.

We may suspend or terminate your Account immediately if you violate these Terms, your activity poses a security or compliance risk, your payment fails or is reversed, or your usage may harm our infrastructure or reputation.

Upon termination, your access will be revoked immediately. Unused credits or subscription time are not refundable unless required by law.

The Service is provided "as is" and "as available" without warranties of any kind, including fitness for a particular purpose, uninterrupted service, data accuracy, or suitability for specific websites or platforms.

To the maximum extent permitted by law, DataHeaven.ai is not liable for indirect, consequential, or incidental damages, data loss, profit loss, or business interruption. Our total liability is limited to the fees paid by you in the three months preceding the incident.

You agree to indemnify and hold DataHeaven.ai harmless from any claims, damages, or expenses arising from your misuse of our Services, violation of these Terms, illegal or unauthorised activities, or third-party claims related to your actions.

We may update these Terms at any time. Revisions will be posted on this page with an updated effective date. Continued use of the Service after any change constitutes acceptance of the revised Terms.
